TERMS OF SERVICE
The financing of tickets purchased on Iberia.com is offered through the installment payment service managed by Iberia Cards.
Through this option, the customer can select “Installment payment” as the payment method when booking their flight and choose the installment plan that best suits their needs.
At that time, the customer formalizes a financing request, the assessment and eventual granting of which will be carried out in accordance with the criteria of Iberia Cards and of the collaborating financial institutions with which it maintains agreements at any given time (Pepper, SeQura, FLOA and Wizink Bank s.a.u, which operates under the Aplazame brand). Iberia Cards will guarantee the presentation of the offer that best fits the customer’s profile, as well as the proper management of the transaction until it is formalized with the corresponding financing institution. Please note that the financing of your flight may be denied for the reasons the financing institution deems appropriate.
Once the plan has been chosen, and the first installment has been paid with their card, the customer will be automatically redirected to the Iberia.com page to confirm their booking. The remaining installments will be charged to their card according to the chosen plan. Once the installment plan has been granted and the booking of your flight has been confirmed, the financing provider may contact you to request any document or additional information.
The use of this service implies acceptance of these terms and the acknowledgement that the provision of the service is carried out by Iberia Cards in its capacity as the provider of the financing service.

2. Purposes and lawful basis of processing.
Presentation to the customer of the financing offer that best suits their request: Iberia Cards, as data controller, will process the personal data collected throughout the ticket purchase process, together with those relating to the financed flight and those belonging to the Iberia Club Program, in order to be able to offer you financing for purchases made with Iberia. Consequently, the main purpose is the management of the financing request made by you, as well as the study, assessment, management and control of the requested transaction.
To this end, once Iberia Cards has all the necessary data, such data will be communicated to the entities in charge of providing the financing service so that they can assess your solvency in relation to the financing request and offer you their services. Iberia Cards will pass on to you the proposal of the entity that offers you the best conditions. The customer may formalize the financing agreement directly with such entity, accepting at that time its conditions together with that entity’s own privacy policy. To assess your solvency, the collaborating financial institutions (Pepper, SeQura, FLOA and Wizink Bank s.a.u) will consult the customer’s data in credit information systems, as well as in the Bank of Spain’s Central Credit Register (CIRBE).
The processing of your personal data by Iberia Cards is legitimized by the necessity for the performance of a contract to which the data subject is party or for the implementation at the data subject’s request of pre-contractual measures (Art. 6.1(b) GDPR). Therefore, completion of all the data requested throughout the entire purchase process and financing request process is mandatory if you wish to obtain a financing offer from any of the financing entities that at any time maintain agreements with Iberia Cards for this purpose. The consequence of not providing data may result in the impossibility of making the requested financing offer available to you.
Sending of commercial communications: Iberia Cards may send, on the basis of its legitimate interest, commercial communications relating to its own products or services similar to those previously contracted by the customer, through any means (email, SMS, mobile application notifications, instant messages, etc.).
In this regard, Law 34/2002, on information society services and electronic commerce, considers this practice lawful. In any case, in each communication received you may object to continuing to receive this type of communications. If you object to this processing you will stop receiving information relating to Iberia Cards products and services.
Preparation of market analyses with anonymized data: Finally, after prior dissociation of your personal data—that is, once they have been anonymized and cannot be linked to an identifiable person—Iberia Cards may process such information to prepare market analyses that make it possible to show trends regarding user behaviour in order to anticipate strategic decisions.
3. Data retention periods and criteria.
Iberia Cards will retain your personal data for the time strictly necessary for the intermediation in the granting of the requested financing and the related actions arising therefrom in which it must intervene.
Once the financing contract has ended, Iberia Cards will keep your data blocked until the expiry of the limitation periods for any possible legal actions arising from the processing carried out. This implies that your data will only be accessed in order to make it available to Public Administrations, Judges and Courts, or the Public Prosecutor’s Office, in response to legally made requests by them, as well as, where applicable, for the exercise by Iberia Cards of the rights that may correspond to it by virtue of its intervention as intermediary in the granted credit agreement. Once the above periods have elapsed, your personal data will be completely deleted.
4. Recipients of disclosures
Your personal data will be communicated by Iberia to Iberia Cards, for the management of the financing request made by you, and to the financial institutions with which Iberia Cards maintains agreements at any given time for the granting of the requested financing. Such management will necessarily entail the disclosure of your identification and contact data to the financial institution so that it can assess your solvency and process your financing request, consulting for this purpose the customer’s data in credit information systems and in CIRBE and determining the viability of the transaction.
Likewise, you are informed that the financial institutions and other related technology service providers to whom the data are transmitted in order to carry out the monetary transactions under this Contract may be obliged by the legislation of the State where they are located or by agreements concluded by it to provide information on monetary transactions to the authorities or official bodies of other countries, located both within and outside the European Union, in the context of the fight against the financing of terrorism and serious forms of organized crime and the prevention of money laundering. In Spain, this legislation is represented by Law 10/2010, of 28 April, on the Prevention of Money Laundering and Terrorist Financing, and Royal Decree 304/2014 implementing it.
5. Rights of data subjects

Any person has the right to obtain information as to whether Iberia Cards is processing personal data concerning them, or not.

Data subjects have the right to access their personal data, as well as to request the rectification of inaccurate data or, where applicable, to request erasure when, among other reasons, the data are no longer necessary for the purposes for which they were collected.

In certain circumstances, data subjects may request the restriction of the processing of their data, in which case we will only retain them for the exercise or defence of claims.

In certain circumstances and for reasons related to their particular situation, data subjects may object to the processing of their data. Iberia Cards will stop processing the data, except for compelling legitimate grounds, or for the exercise or defence of possible claims.

Where applicable, you may request the portability of your data.
In relation to your data used in the provision of the intermediation service for the attainment of the financing of purchases made at Iberia LAE, in order to exercise your rights, you must send your request by email to atencionalcliente@Iberiacards.com.
You are informed that you may request additional information about our Personal Data Protection Policy from Iberia Cards’ Data Protection Officer (DPO) through the email address detailed in the first section of this clause.
In any case, you may lodge a complaint with the Spanish Data Protection Agency, especially when you have not obtained satisfaction in the exercise of your rights. The Agency’s address is C/ Jorge Juan 6, 28001 and its website is www.aepd.es.
6. Source of the data
The data processed originate from Iberia Líneas Aéreas de España and have been collected throughout the purchase process carried out with said Company, as well as from the Iberia Club program in the event that you are enrolled in it, and their communication to Iberia Cards as financial intermediary for the granting of the financing requested by you being necessary.
Identification data: the data that will be processed under this clause will be personal identification and contact data, as well as the specific data of the flight subject to financing and your Iberia Club program data.
Continuing with the financing process initiated by you implies acceptance of this privacy policy, which you declare you have read.
