1. What is “FlexibilityOffer”
Flexibility Offer is an initiative from IBERIA purported to offer to certain Customers discretionally selected by IBERIA in certain flights on which a high level of occupation is foreseen and provided that such Customers have flexibility to change their Original Booking, the chance to do so in exchange for certain benefits in the terms explained under these Terms and Conditions (the “Program Benefits”).
These Program Benefits are offered in such cases pursuant to and in application of Article 4.1 of Regulation (EC) No 261/2004 of the European Parliament and of the Council of 11 February 2004 establishing common rules on compensation and assistance to passengers in the event, amongst others, of denied boarding (the “EC Regulation 261”) and only as long as EC Regulation may be applicable to such a case.
2. Definitions
The following definitions apply to IBERIA FlexibilityOffer Terms and Conditions:
2.1 Alternative Flight is the Segment(s) for which an Invited Customer has received an Offer to move to and is at a different departure time to the Original Booking.
2.2 Invited Customer refers to the recipient to whom Iberia, in its absolute and sole discretion, extends an Offer.
2.3 Offer refers to an offer that Iberia sends to the Invited Customer to change a Segment of their Original Booking to an Alternative Flight at a different departure time in exchange for an Iberia Program Benefit or any other form of compensation.
2.4 Original Booking is the fare purchased and Segment(s) of the booking made by the Invited Customer to which an Offer extends.
2.5 A Discount Iberia Code may be redeemed for the purchase of Iberia one-way or return domestic or international flights departing within the validity period of the Iberia Discount Code in question. Iberia Discount Codes are subject to the terms and conditions available at 该产品的信息页面.
2.6 Segment refers to the portion of a journey between two consecutive points on an itinerary.
2.7 Program Benefits refer to either the Iberia Discount Vouchers, Iberia Upgrade Rewards, Iberia AVIOS Rewards, or other benefits as determined at the sole discretion of Iberia.
2.8 Iberia Upgrade Rewards refer to a class of service upgrade that Invited Customers receive when they accept the Offer to change their Original Booking to the Alternative Flight.
2.9 Iberia AVIOS Rewards refer to AVIOS points that Invited Customers receive when they accept the Offer to change their Original Booking to the Alternative Flight.
3. Offer Terms and Conditions
The following Terms and Conditions apply specifically to Offers.
3.1 The Iberia Conditions of Carriage apply to all travel with Iberia as defined in those conditions.
3.2 Invited Customers must be at least 18 years of age to accept an Offer, unless duly represented by his/her parent or legal guardian.
3.3 Iberia may, in its absolute and sole discretion send an Offer to an Invited Customer.
4. Iberia Offer
4.1 Iberia may send an Invited Customer an Offer for one or more Segments on the Original Booking.
4.2 Offers are open for a limited time frame and for a limited set number of seats. Offer acceptance by Invited Customers will be fulfilled on first come first serve basis.
4.3 Iberia may withdraw an Offer at any time if the Offer has been fully subscribed.
4.4 If an Offer has been fully subscribed then an Invited Customer that responds to an Offer after it has been withdrawn will keep his/her Original Booking.
4.5 The Invited Customer will not be notified when the Offer is concluded if they do not respond to the Offer.
4.6 An Offer is for all passengers on the Original Booking and must be accepted by an Invited Customer for all passengers on the Original Booking.
4.7 By responding to an Offer, the Invited Customer confirms that he or she is an Invited Customer and has authority to act on behalf of and to bind all the passenger(s) on the Original Booking.
4.8 If an Invited Customer's Original Booking is changed or cancelled after an Offer is sent to that Invited Customer and before the Invited Customer accepts the Offer, the Offer will not be valid.
4.9 If the Original Booking is changed or cancelled after the Invited Customer has responded to Offer but before the rebooking to the Alternative Flight has been confirmed by Iberia the Offer may be invalid.
5. Acceptance Offers
5.1 To accept the Offer the Invited Customer must respond to the Offer and choose [among the] Alternative Flight/s proposed through the means made available by IBERIA to the Invited Customer, and then reconfirm acceptance by following the instructions provided.
5.2 An Offer accepted shall not be deemed confirmed until the Invited Customer receives confirmation back from Iberia confirming that the Original Booking has been changed by incorporating the Alternative Flight into it.
5.3 If the Invited Customer does not respond to the Offer, then his/her Original Booking will not be changed and it will be deemed as a declined Offer.
5.4 When an Offer is accepted and confirmed, and if the Iberia Program Benefit is an Iberia Discount Voucher, then an Invited Customer will be sent an Iberia Discount Voucher to the email contained in their Original Booking, for the amount initially offered in the Offer.
5.4.1 Discount Voucher amounts may vary by Offer and may be denominated in Euros, UK Pounds Sterling, or US Dollars, as applicable.
5.4.2 The redemption and use of Iberia Discount Voucher is subject to the Iberia Discount Voucher Terms and Conditions available at 该产品的信息页面.
5.5 When an Offer is accepted and confirmed, and if the Iberia Program Benefit is an Iberia Upgrade Reward, then within 48 hours from confirmation by Iberia the Invited Customer will be sent an updated itinerary via e-mail, reflecting this Upgrade Reward for all passengers included in the Original Booking for the affected Segment.
5.6 When an Offer is accepted and confirmed, and if the Iberia Program Benefit is an Iberia AVIOS Reward, then within 7 days from confirmation by Iberia the amount of AVIOS points in the Offer will be deposited in the Invited Customer’s AVIOS account.
5.7 The fare conditions of the Original Booking continue to apply to the Alternative Flight booking.
5.8 Any special requests, including meal or seating requests, whether or not included in the Original Booking, will not be guaranteed for the Alternative Flight.
5.9 The earning and redemption of Avios is subject to the Iberia Plus Terms and Conditions.
6. Cancellations
6.1 The Original Booking may no longer be available if an Alternative Flight booking is cancelled later on.
7. General
7.1 Iberia reserves the right to modify these Terms and Conditions at any time, without notice. These Terms and Conditions should be read in conjunction with our Conditions of Carriage, our Website Terms of Use and our Data Protection and Privacy Policy shown in our website www.iberia.com; the Iberia Discount Voucher Terms and Conditions and the Iberia Plus Terms and Conditions (where relevant).
7.2 Failure by Iberia to exercise its rights will not be construed as a waiver or relinquishment of the future performance of any of its rights, and the Invited Customer's obligations with respect to such future performance shall continue in full force and effect.
